State Wheels (SW) offers the following warranty to the original purchaser accompanied by proof of purchase:
SW warrants that its products, as delivered, will be free from material defects in workmanship and material for 5 years (60 months) from the date of original purchase. If the purchaser discovers a material defect in workmanship or materials within this period, the purchaser must promptly notify SW. In the event that a product does contain a material defect in workmanship or materials and proper notification is provided as required, then within a reasonable time after notification, SW will, at its option, correct any material defect in workmanship or materials or provide equivalent parts or products. If SW is unable to repair the product to conform to this limited warranty, SW will, within its sole discretion, provide a replacement product or a full refund of the purchase price, less a reasonable discount for use. Any such repair, replacement, or refund will not extend the time period of this warranty.
This warranty does not apply to any defects caused by negligence, misuse, mishandling, alteration, abuse or accidents. This warranty does not cover damages that occur as a result of shipment, storage, or use not consistent with the original intent for the product, neglected or poorly maintained products, improper assembly, assembly or combination with non-compatible products, normal wear and tear, or modifications to the original product. This warranty specifically excludes surface finishes and cosmetic treatments including but not limited to surface finishes and decals.
In the event of legal action, the sole venue for all claims or disputes will be the courts of Travis County, the State of Texas and be subject to Texas law, without regard to conflicts of law provisions.
THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY OR FITNESS, AND THE WARRANTY AGAINST INFRINGEMENT SPECIFIED IN THE UNIFORM COMMERCIAL CODE. ALL OTHER WARRANTIES ARE EXPRESSLY DISCLAIMED TO THE FULL EXTENT SUCH MAY BE DISCLAIMED BY LAW.
